The Georgia General Assembly passed the half-way mark last Thursday, and have now recessed until March 8. The long recess will give House and Senate leaders much needed time to balance the budget in the face of continued revenue declines. Committees are expected to continue meeting during the recess.

Transportation bill introduced

The long awaited Administration bill on transportation funding was introduced last week.  As expected, HB 1218 would create special transportation districts corresponding to the boundaries of existing regional commissions. Citizens within each district could decide by referendum whether to levy a one cent sales tax to fund transportation projects in their districts. The tax would be imposed within that district for a period of eight years.

They types of transportation projects that would be available for the funds are new or existing roads, bridges, bus and rail mass transit systems, freight and passenger rail, airports, and ports.

Currently, Georgia freight rail companies pay a sales tax on diesel fuel that ultimately goes toward funding road and bridge projects. GRA would be opposed to any additional tax that the freight rail industry can see no benefit from and more importantly put them at a further competitive disadvantage. The first hearing in committee for HB 1218 is this Wednesday morning.

Senate amends and passes medical network bill

The Senate passed SB 50, the bill to restrict application of provider network discounts in health plans. Senator Seth Harp added two damaging amendments to increase penalties and encourage lawsuits.

SB 50 would restrict the ability of “contracting entities” to “grant access to a provider’s health care services and contractual discounts.”  Contracting entities, which apparently would include self-insured employers and third party administrators, would be required to register with Commissioner of Insurance and maintain a web site where providers can obtain a listing of parties granted access to the network and contractual discounts.  As passed by the Senate, SB 50 also appears to include medical plans under workers compensation.

Despite the 50- 1 vote in the Senate, SB 50 is expected face much greater scrutiny in the House Insurance Committee.

HB 204 Sims 169th amend Part 1 of Article 1 of Chapter 8 of Title 48 relating to general provisions regarding sales and use taxation, so as to change certain provisions regarding applicability of sales and use tax to motor fuel sales; to provide for an exemption from state sales and use tax on the sale or use of diesel fuel used to propel locomotives.
